Former Korn drummer David Silveria is suing his old band mates for money owed after the band declined to allow the drummer back in the group following a lengthy break. According to TMZ, Silveria sued Jonathan Davis, James “Munky” Shaffer, Brian “Head” Welch, and Reggie “Fieldy” Arvizu in an effort to reclaim the money owed to him and his “ownership interest” in the band since his departure. If Silveria is repaid what he believe he is owed from the past nine years, he will dissolve his partnership with the group.
Silveria left Korn in 2006 in order to go on what was labeled as a “hiatus.” Ray Luzier was recruited to fill in for Silveria and remains the band’s drummer after being named a full-time member in 2009. According to Silveria’s suit, the drummer is also upset that, even though his band mates wouldn’t take him back following his own hiatus, they did welcome back Welch after he became a born-again Christian and left the group for seven years.
Last year, Korn celebrated the 20th anniversary of their 1994 self-titled debut album by announcing plans to perform the LP in its entirety during select 2015 dates. However, Silveria was not asked to rejoin the group to revisit their classic album.
“I feel like it was wrong to go play this record without me, because I was just as much of a creative input as any of these guys while writing and making this record,” Silveria told Rolling Stone in an oral history of Korn. “So I think it was wrong to do it without me, but it’s not really weird. They’ve been playing and touring for years without me. I just think they should’ve asked me to come play the tour.”
